It is likely no different than certain add ons to Kodi. It is not Kodi providing the questionable sources.
Isn't over 90% of content protected by DRM? How do you legally watch movies on Plex locally (without subscribing to a streaming service)? I get that they aren't supplying the content, but who are they marketing to?
Nobody in the US has been prosecuted for removing DRM from DVDs and BluRays because they actually don't want a court challenge on DMCA law.
